Nick Diaz?s attorney doesn?t take kindly to calling his client a liar

Nick Diaz's disciplinary hearing in front of the Nevada Athletic Commission for allegedly failing a post-fight drug screen after his loss to Carlos Condit on Feb. 4 in Las Vegas at UFC 143 figures to be a doozy.

The hearing isn't scheduled yet, though it's expected to be sometime next month. If things remain as contentious as they have been between Diaz's attorney Ross Goodman and the commission this week, tickets are going to be harder to come by than those for the Final Four.

Goodman has taken an aggressive stance and asserts that Diaz has not tested positive for a banned substance. Goodman argues that Diaz did not test positive for Delta-9-THC, the active ingredient in marijuana, but rather for marijuana metabolites. Those metabolites are an inactive ingredient in marijuana and are not on the World Anti Doping Agency's banned list that Nevada uses, Goodman said.

Goodman is clearly going to fight the case bitterly, and on Thursday, he railed against statements made by the public information officer for the Nevada attorney general's office.

Yahoo! Sports on Monday and Tuesday reached out to Christopher Eccles, the Nevada deputy attorney general who represents the athletic commission, seeking comment on points Goodman raised. Under a new policy instituted by attorney general Catherine Cortez Masto, however, her deputies are not allowed to speak to the media as they have in the past.

As a result, public information officer Jennifer M. Lopez returned the call for Eccles and later released a statement. Via email, Lopez said, "Not only did Nick Diaz violate the law by testing positive for marijuana metabolites, but he also lied to the Commission on his Pre-Fight Questionnaire when he swore that he had not used any prescribed medications in two weeks before the fight."

It is unusual for a spokesperson for an attorney general's office to call a person who will soon have a hearing in front of a state regulatory agency a liar.

Her statement probably wouldn't have been given much notice, though, had she said Diaz must have been mistaken when he checked no to a question asking if he'd taken any prescription medications in the preceding two weeks prior to the Feb. 3 weigh-in.

But saying outright that Diaz lied put Goodman even more in attack mode. He came out swinging on Thursday and insisted that Diaz did not lie when he checked no when he said he had not taken any prescription medications in the preceding two weeks.

The Nevada law that deals with medical marijuana doesn't regard it as a prescription drug. No doctor is able to prescribe it because it is a controlled substance.

Chapter 453A.210 of the Nevada Revised Statutes lays out the requirements to obtain a registry card for medical marijuana. To get the card, patients must comply with the following regulations:

(1) The person has been diagnosed with a chronic or debilitating medical condition;
(2) The medical use of marijuana may mitigate the symptoms or effects of that condition; and
(3) The attending physician has explained the possible risks and benefits of the medical use of marijuana;
(b) The name, address, telephone number, social security number and date of birth of the person;
(c) Proof satisfactory to the Division that the person is a resident of this State;
(d) The name, address and telephone number of the person's attending physician; and
(e) If the person elects to designate a primary caregiver at the time of application:
(1) The name, address, telephone number and social security number of the designated primary caregiver; and
(2) A written, signed statement from the person's attending physician in which the attending physician approves of the designation of the primary caregiver.

"Nowhere in there does it say that the attending physician is prescribing marijuana," Goodman said. "And so, for obvious reasons, before you speak and call someone a liar, you think you'd do a little bit of due diligence and understand what the Nevada law actually says."

Diaz manager Cesar Gracie said in a 2009 interview with MMA Fighting that "Nick has a prescription for marijuana in California. He has had a prescription for the last couple years, so it's a legal drug for him. He has the prescription for ADHD [Attention-Deficit Hyperactivity Disorder], and he says it helps him."

But Goodman said it is all irrelevant. He said no reasonable person regards marijuana as either a prescription drug or an over the counter medication.

"It's not like you walk into the pharmacy and start looking around on the shelves and hope to pick up a bag of marijuana," Goodman said. "That's ridiculous. No reasonable person would believe that medical marijuana falls under the category of over the counter medications."

Curiously, though, in his response to the commission, Goodman himself made a big deal about a prescription. He referenced NRS 484C.210, which deals with prohibited substances. Goodman bolded a section which said "if the person who uses the substance has not been issued a valid prescription ... "

Diaz may ultimately be forced to accept a lengthy suspension. He was suspended for six months in Nevada in 2007 for failing a marijuana test. On Jan. 31, boxer Matt Vanda had a hearing after testing positive for a second time. Vanda was suspended for a year and fined 40 percent of his purse.

If Diaz goes down, though, he's not going to make it simple on the commission. This isn't going to be a case where the fighter hangs his or her head, is lectured to by the commissioners and then apologizes profusely and meekly accepts the punishment issued.

Goodman will make certain of that.

Eric Prindle (7-1-0-1) just picked up the easiest title he?ll likely ever claim. The man didn?t even have to step foot in a cage to pick up the title of Bellator Tournament Winner, as his opponent, Thiago Santos (10-1-0-1), missed weight be a sizeable discrepancy.<BR><BR>

In advance of tonight's Bellator 62 event, Thiago Santos tipped the scales at a staggering 277.8 pounds, nearly thirteen pounds above the contractual limit of 265 pounds.<BR><BR>

The default win lines Prindle up for a crack at the current Bellator heavyweight champion, Cole Konrad (8-0) at a yet to be determined future event.<BR><BR>

Santos?s blunder marks a second failed effort to put this rematch together (the two first battled at Bellator 59, when Prindle suffered a fight ending groin shot, which resulted in a No Contest ruling), as the two were slated to meet at Bellator 61, but Prindle fell ill prior to the match.<BR><BR>

The weeks are ticking away leading up to the UFC Light Heavyweight showdown between heated rivals Rashad Evans and Champion Jon Jones, and to keep fans up on training and such, Evans has been blogging via <a href=http://sports.yahoo.com/mma/news;_ylt=AhPxTehuhBjUqoHl9jkQssA9Eo14?slug=ys-rashad_evans_jon_jones_UFC_145_blog_032212>Yahoo Sports</a> and this week discussed why beating Jones is more important than winning the title as well as why he feels he's a bad style match up for the seemingly unbeatable Jones:<br><br>

"In one month, on April 21 in Atlanta, I'm getting my title back but, to me, beating Jon Jones up and proving I am the better man and better fighter is even more important than waking up the next day as a two-time UFC champion.<br><br>

For someone who says he doesn't talk a lot, Jon talks a hell of a lot. If there's any validity to what he's saying, if there's any truth to him being the "Muhammad Ali of MMA," then he's got to deal with me. It's not a fight he is taking lightly, I'm sure. Jon always trains hard, and I know he will be training extra hard for this fight against me.<br><br>

I heard a stat about Jon that he's never been taken down in the UFC. But I've taken him down plenty, and I know he can't fight off his back. I think my takedowns will be a key to this fight. I know Jon can take me down, too - he's done it - but I've taken down every single fighter I've ever wanted to get down, and I took Jon down time and time again in the gym. I think style-wise I am all wrong for him."<br><br>

Knockout of the week: Michael McDonald takes out Alex Soto

The good news for Miguel Torres? At UFC 145, he will have his first fight since getting cut, then rehired by the UFC. The bad news? It's against Michael McDonald, a bantamweight barely old enough to buy beer in the U.S. McDonald is on a seven-bout winning streak, and in his last fight, he did this:

Torres is one of the most experienced bantamweights in the UFC. At 31, he has 44 fights under his belt. The former WEC champ is 2-1 in the UFC, with the loss coming in a tight decision to Demetrious Johnson.

But nothing moved more people to speak than Quinton "Rampage" Jackson's tweets about his next fight being his last one in the UFC. Instead of drawing sympathy, Jackson drew the ire of quite a few Cagereaders.

Five to watch at NCAA Division I wrestling championships

The NCAA Division I wrestling national championships start on Thursday in St. Louis, and it will undoubtedly feature future stars of MMA. Randy Couture, Mark Munoz, Urijah Faber, Phil Davis, Ben Askren, Chael Sonnen, Tyron Woodley, Daniel Cormier, Chad Mendes, Frankie Edgar, Gray Maynard, Josh Koscheck, Brock Lesnar and so many more familiar names from the fight world once wrestled in this tournament. MMA fans should tune in, so here's what you need to know.

Penn State has the ability to repeat as champions. They won the Big Ten title last week, but will have plenty of challengers. Minnesota won the dual meet championship earlier this year. Missouri won the Big 12 and was the only team in the country to qualify a wrestler at every weight class. (Ed. note -- GO TIGERS!) Cornell won their sixth straight EIWA title. Perennial powers Oklahoma State and Iowa will also be expected to challenge for a team trophy.

The 2012 field isn't as star-studded as some of the top wrestlers, like Mizzou's Dom Bradley, took a redshirt to focus on making the U.S. Olympic teams. Well known wrestlers like Anthony Robles and Bubba Jenkins from Arizona State and Jordan Burroughs from Nebraska have graduated. However, there are plenty of wrestlers to watch during the tournament.

Kyle Dake, Cornell: When Dake was a freshman, he wrestled at 141 lbs. and won a national championship. His sophomore year, he moved up at 149 lbs. again took home the title. This year, he is a junior and at 157 lbs. His goal is to keep the streak alive.

Ian Miller, Kent State: The freshman has taken the MAC by storm this season, going 28-3. He won the MAC at 149 lbs., and already has 11 pins and nine major decisions (winning by 8-14 points).

Frank Molinaro, Penn State: When you picture a wrestler in your mind, you are most likely picturing Molinaro. He's looking to become a four-time All-American and win his first championship in St. Louis this weekend and is the favorite at 149 lbs after winning the Big Ten title with a technical fall (winning by 15 points or more) in the finals.

Jordan Oliver, Oklahoma State: The same school that produced Munoz, Cormier, Mo Lawal, Johny Hendricks and Shane Roller has another star in the making with Oliver, the returning national champ at 133 lbs. He won the Most Outstanding Wrestler award at the Big 12 tournament for plowing through competition and racking up bonus points. (Wrestlers earn their teams bonus points for winning by pin, technical fall or major decision.)

Zack Rey, Lehigh: As the returning champion at heavyweight, expectations will be high for Rey, who is known for having insane strength. He lost to American's Ryan Flores in a sudden victory match at the EIWA final, so he'll be on the lookout for revenge.

HYDEN BLOG: Dana White's Comments on Soccer Completely Unnecessary

At the UFC 149 press conference last week Dana White showed once again that he's not ready for primetime. This is a portion of Dana's comments:

"I?m not a big hockey fan. But I respect how talented you have to be to play hockey. Soccer? That?s a whole other ball. Can?t stand soccer. It?s the least-talented sport on Earth. There?s a reason three-year-olds can play soccer."

Dana goes on to complain about the lack of scoring in soccer while talking up hockey. It's pretty obvious that Dana was trying to get in good with Canadian hockey fans (the press conference was in Calgary), but he went about it in about the worst way possible. In other words, he went about it in his typical way.

I understand and appreciate the way that Dana calls it the way he sees it, but he needs to show more judgement while doing this. A man in his position shouldn't be making such statements, they're reckless and foolish. He represents the UFC, and these kinds of statements reflect poorly on the company. It shows a serious lack of tact and responsible thinking to denigrate an entire sport, especially when he was just trying to smooth talk hockey fans.

Why even bring soccer into it? Why couldn't he just have left it at talking how much he respects hockey and the players? There's a reason coaches and other high-rankings members of a sports league all sound like robots, you're not supposed to act like some schmoe in a bar after he's had a few too many. It's not necessary to go that far, though. In fact, it's preferable if you don't. Rex Ryan coaches the New York Jets in the NFL, and he's far from a robot. I love the way Ryan coaches and the way he handles himself. Dana White routinely makes bombastic statements, and that's fine as long as he doesn't trash an entire sport.

I don't like soccer, it's not for me. I don't like baseball either. I don't care much for hockey, to be honest. I don't go around trashing those sports, though. If a regular guy like me knows that, then why does this concept so elude Dana?

What makes this even worse is that the UFC is trying to sell-out a soccer stadium in Rio de Janeiro, Brazil for the UFC 147 rematch between Anderson Silva and Chael Sonnen. Didn't Dana think that trashing soccer might piss off a lot of potential fans in Rio? The UFC is targeting 80,000 seats for this stadium, they need as much goodwill as they can get. Dana just recently said that UFC 147 will be bigger than anything, the NFL, the NBA, or anything else. While that's not true, but there's no harm in him saying that. Hell, we expect it, he's supposed to say stuff like that.

It's time for Dana to evolve past this type of behavior. One of the prices you pay for success is that you can't act the way you always have. Considering that they televise the sport, I wonder what the folks at FOX think about Dana putting down soccer in that manner?

?Rampage? Jackson unhappy with pay, wants to fight outside the UFC

From the department of biting the hand that feeds you, Quinton Jackson complained on Twitter about the UFC and said his next fight in the UFC will be his last.

"I feel sorry for my next opponent, no matter who or what it is," Jackson wrote via Twitter. "I will fight whoever they put in front of me ? I always have ? but it will be my last fight in the UFC.� I have other things on my mind. I didn't say I would be done fighting; I just said I'm not fighting for the UFC (u fight cheap)."

Jackson's most recent salary information was from UFC 96 in 2009, where he made $325,000. It doesn't count locker room bonuses, sponsorship money or a cut of the pay-per-view. As a headliner, it's likely Jackson's contract calls for pay-per-view money.

To review, the UFC stood by Jackson as he went on a hit-and-run driving rampage, as he took a break from fighting to film "The A-Team" plus do all the publicity required for the movie, during the many times he treated media like a punching bag, and when he insulted their own color commentator and another fighter working as an analyst.

Before UFC 144, the UFC's doctor sent him to an age specialist, who gave him testosterone therapy and helped make him healthy enough to fight and enjoy himself more in the bedroom.

There are fighters who have a legitimate reason to be unhappy with their pay and treatment by the UFC. Jackson is not one of them.

Nick Diaz announced his retirement from MMA following a UFC 143 loss to Carlos Condit earlier this year and that was followed up with an announcement from the NSAC that Diaz had failed a drug test, testing positive for marijuana metabolites.<Br><Br>

Nick Diaz's coach Cesar Gracie was a guest on Sherdog Radio yesterday and discussed his pupil's decision to retire from MMA as well as the drug test Diaz failed and the issues surrounding it:<Br><Br>

"It might be a good thing because will they make the Nevada State Athletic Commission explain themselves? ... Marijuana's like alcohol. You can't be drunk for your fight and you can't be high on marijuana for your fight. But they don't test to see if you, a month before, if you drank alcohol. Oh my God, we're going to have to fine you because you drank alcohol a month before your fight or eight days or two weeks or whatever they want to say. You can get drunk the night before your fight. You just can't get drunk the day of your fight.<Br><Br>

"Their testing policy does not make sense, not only to the layman like you and me but also to the World Anti-Doping Agency. They don't test the way that [the NSAC does]. They don't do the metabolites, I think it's called. That just shows if you had weed in your fat cells that was stored there up to 45 days before your fight. It doesn't make sense.<Br><Br>

"He's sick of the politics, the whole marijuana thing, the judges ... . It's kind of a weird thing, but let's face it: I'm not going to let that guy quit. I just don't see that happening. He's too good and he's too important in this sport, I think. If it's up to me, there's no way that's going to happen."<Br><Br>

Chael Sonnen hasn't yet signed on for UFC 147 bout with Anderson Silva, says "my demand has not been met"

Though the UFC has announced the rematch between Anderson Silva and Chael Sonnen for UFC 147 in Rio de Janeiro, Sonnen has not yet signed his fight contract for the bout.

In a comment made to MMAFighting.com, Sonnen gave a simple explanation as to why, but didn't expand on his reasoning.

"My demand has not been met," Sonnen said. "I've signed nothing."

His manager said it's essentially a formality at this point, but Sonnen said his demand is still to come, and he'll sign once that demand is made and met.

Penick's Analysis: There's not a chance that this is anything more than Chael being Chael. He may have some type of demand as another attempt to stir the pot, much like his challenge to Silva in the cage after defeating Brian Stann last October, but he'll sign on for the fight, and it will go through. This is just more posturing and him trying to rile people up. I'm sure we'll see what his "demand" is, if there is one, in the coming days, but I don't believe for a second that the fight is in danger.
